Terms of Service

Welcome to FORME ("we," "our," or "us"). By accessing or using forme.gifts (the "Service"), you agree to these Terms of Service ("Terms"). If you don't agree, please don't use the Service.
1. About FORME
FORME is a wishlist platform that helps users create and share curated gift lists with friends and family. We believe in intentional gift-giving that reduces waste and ensures people receive gifts they actually want.
2. Eligibility
You must be at least 13 years old to use FORME. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
3. Account Registration
3.1 Creating an Account
- You must provide accurate information when creating an account
- We support Google OAuth and magic link (email) authentication
- You're responsible for maintaining the security of your account credentials
- You must notify us immediately of any unauthorized access
3.2 One Account Per User
Each person may only maintain one FORME account. Multiple accounts by the same individual are prohibited.
4. How FORME Works
4.1 Wishlist Creation
- All users start on the Free tier, which includes one wishlist with up to 15 gifts
- Paid subscription tiers unlock additional wishlists and higher gift limits (see Section 5 for details)
- You can add gifts with names, descriptions, images, price ranges, and product links
- Your wishlists remain private until you share them
4.2 Sharing Your Wishlist
- You can generate a unique share link for each of your wishlists
- Anyone with this link can view your wishlist without creating an account
- You can regenerate your share link at any time to revoke previous access
- Treat your share link like a password—only share it with people you trust
4.3 Gift Booking (For Gift-Givers)
- Gift-givers can "book" items on your wishlist to indicate they intend to purchase them
- Booking requires signing in with a Google account
- Booked items are hidden from other gift-givers to prevent duplicates
- You (the wishlist owner) cannot see which specific items have been booked or by whom
- Gift-givers can view and manage their bookings from their account dashboard
4.4 Limitations on Deletions
You cannot delete gifts that have already been booked by someone. This protects gift-givers who have already committed to purchasing an item.
5. Subscription Plans
5.1 Tier Overview
FORME offers the following subscription tiers:

All non-free tiers share the same feature limits. The distinction between them is billing and origin, not feature access.
5.2 Free Tier
Every user starts on the Free tier. You can create one wishlist with up to 15 gifts at no cost. When you reach your tier limits, you will be prompted to upgrade but are never required to do so.
5.3 Plus Tier
The Plus tier is available for €48/year, billed annually through our payment partner Creem. Plus subscribers can create up to 10 wishlists with up to 30 gifts per list.
5.4 Founding Member Tier
The Founding Member tier is available at a discounted rate of €24/year for early supporters. This tier offers the same features and limits as Plus. Founding Member pricing is locked in for as long as the Service remains operational, provided your subscription remains active. Founding Member availability is limited and may be closed to new subscribers at any time.
5.5 Complimentary Tier
The Complimentary tier may be granted at our sole discretion (e.g., to contributors, partners, or for promotional purposes). It provides the same features and limits as Plus. Complimentary access may be revoked at any time and does not constitute a permanent entitlement.
5.6 Wishlist Locking
If your tier changes and you exceed the limits of your new tier (e.g., after a downgrade from Plus to Free), your oldest wishlists by creation date remain fully editable up to your tier's limit. Any additional wishlists become read-only ("locked"). You can still view and delete locked wishlists, but you cannot edit them or add gifts to them. Upgrading your tier unlocks all wishlists.
5.7 Changes to Plans
We may modify subscription pricing, features, limits, or tier availability at any time. If you have an active paid subscription, changes to pricing will take effect at the start of your next billing period. We will provide reasonable notice of material changes.
6. Payments & Billing
6.1 Payment Processing
All payments are processed by Creem, which acts as our merchant of record. We do not directly store your credit card numbers or payment credentials. Your payment information is subject to Creem's terms and privacy policy.
6.2 Billing Cycle
Paid subscriptions are billed annually. Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date.
6.3 Refunds
Refund requests are handled in accordance with Creem's refund policy. Contact us at support@forme.gifts if you have billing concerns.
6.4 Cancellation
You may cancel your subscription at any time. Upon cancellation:
- You retain access to your paid tier's features until the end of your current billing period
- At the end of the billing period, your account is downgraded to the Free tier
- If you exceed Free tier limits, wishlist locking applies (see Section 5.6)
7. User Content
7.1 Your Content
You retain ownership of all content you post to FORME (wishlist names, descriptions, images, etc.). By posting content, you grant us a license to store, display, and transmit that content as necessary to provide the Service.
7.2 Content Guidelines
You agree not to post content that:
- Violates any laws or regulations
- Infringes on intellectual property rights
- Contains malware, viruses, or harmful code
- Harasses, threatens, or harms others
- Contains explicit sexual content or promotes illegal activities
- Impersonates others or misrepresents your affiliation
7.3 Image Uploads
- You must own or have rights to any images you upload
- We store images on secure cloud infrastructure (Cloudflare R2)
- We reserve the right to remove images that violate these Terms
8. Privacy & Data
8.1 Booking Privacy
When gift-givers book items, the booking is linked to their authenticated account. Wishlist owners cannot see who booked which items. Gift-givers can view and cancel their bookings from their account dashboard.
8.2 Anonymous Browsing
Gift-givers can view shared wishlists without creating an account. We may collect basic analytics (page views, browser type) but do not track individual anonymous users across sessions.

9. Prohibited Uses
You agree not to:
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers
- Scrape, harvest, or collect user information
- Use automated tools (bots, scrapers) without permission
- Reverse engineer or attempt to extract source code
- Resell or commercially exploit the Service
- Impersonate FORME staff or other users
10. Third-Party Links
Your wishlist may contain links to third-party websites (e.g., product pages on Amazon, Etsy, etc.). We are not responsible for:
- The content, accuracy, or practices of these third-party sites
- Any transactions you make with third-party sellers
- Product quality, shipping, or customer service issues
Always review the terms and policies of any site you visit through FORME links.
11. Intellectual Property
11.1 FORME's Rights
The Service, including its design, code, features, and branding, is owned by FORME and protected by copyright, trademark, and other intellectual property laws.
11.2 Your Rights
You may not copy, modify, distribute, sell, or lease any part of our Service without explicit written permission.
12. Service Availability
12.1 No Guarantee of Uptime
We strive to keep FORME available 24/7, but we don't guarantee uninterrupted access. The Service may be unavailable due to:
- Scheduled maintenance
- Technical issues
- Force majeure events
- Third-party service outages (e.g., hosting providers)
12.2 Changes to the Service
We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We're not liable for any modification, suspension, or discontinuation.
13. Account Termination
13.1 Your Right to Terminate
You may delete your account at any time through your account settings. Upon deletion:
- Your wishlists and gifts will be permanently removed
- Active bookings will remain valid to honor gift-givers' commitments
- Any active paid subscription will not be refunded for the remaining billing period
- We may retain certain data as required by law or for legitimate business purposes
13.2 Our Right to Terminate
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Pose a security risk to the Service or other users
- Remain inactive for an extended period (with notice)
14. Disclaimers
14.1 "As Is" Service
FORME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR RELIABILITY
14.2 No Guarantee of Gifts
FORME is a wishlist platform. We do not:
- Guarantee that anyone will purchase gifts from your wishlist
- Verify that booked items are actually purchased
- Mediate disputes between users and gift-givers
- Handle any aspect of gift purchasing, shipping, or delivery
14.3 Product Information
Product links, prices, and descriptions on wishlists are provided by users. We don't verify their accuracy and are not responsible for:
- Price changes
- Product availability
- Product quality or safety
- Seller practices
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORME AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, DATA, USE, OR GOODWILL
- SERVICE INTERRUPTIONS OR DATA LOSS
- ANY DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN SUBSCRIPTION FEES IN THE PAST 12 MONTHS, OR €100, WHICHEVER IS GREATER.
Some jurisdictions don't allow these limitations, so they may not apply to you.
16. Indemnification
You agree to indemnify and hold harmless FORME from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your violation of these Terms
- Your use of the Service
- Your content or conduct
- Your violation of any third-party rights
17. Dispute Resolution
17.1 Governing Law
These Terms are governed by the laws of Spain and, where applicable, the laws of the European Union.
17.2 Informal Resolution
Before filing a claim, you agree to contact us at legal@forme.gifts to resolve the dispute informally. We will make reasonable efforts to resolve the matter within 30 days.
17.3 Dispute Resolution
If we cannot resolve a dispute informally, you may pursue your claim through the courts of Spain. EU consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. Nothing in these Terms limits your rights as a consumer under applicable EU or local law.
18. Changes to These Terms
We may update these Terms from time to time. When we do:
- We'll update the "Last Updated" date at the top
- We'll notify you of material changes via email or in-app notification
- Continued use of the Service after changes constitutes acceptance
If you don't agree with the updated Terms, you must stop using the Service.
19. General Provisions
19.1 Entire Agreement
These Terms constitute the entire agreement between you and FORME regarding the Service.
19.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
19.3 No Waiver
Our failure to enforce any right or provision doesn't constitute a waiver of that right or provision.
19.4 Assignment
You cannot assign or transfer these Terms. We may assign our rights and obligations without restriction.
19.5 Force Majeure
We're not liable for delays or failures due to circumstances beyond our reasonable control.
